I was arrested and the police took $1300 from me. I was later released and no charges were filed when I asked for the money they had of mine they said I would have to wait 30 days and gave no futher explaination. Its been 30 days and I still cant find out where my money is or how to get it back.

I HAD THAT HAPPEN TO ME WHEN I WAS 18 & JUST GOT A TAX REFUND BACK. BUT I ALSO HAD THE SAME NAME AS SOMEONE WITH A WARRANT & WHEN THEY COMPARED FINGERPRINTS IT SHOWED THAT THEY HAD THE WRONG PERSON; I WAS RELASED & NO CHARGES WERE FILED. HOWEVER, I STILL HAD TO GO THROUGH THE PROCESS OF BEING BOOKED WHICH WAS EMBARRASSING.

AFTER THE 30 DAYS WHEN I CONTACTED THE INVESTIGATORS ABOUT MY $ THEY HAD ME GO TO THE LOCAL COURTHOUSE WITH MY RECEIPT & HAVE A JUDGE SIGN A RELEASE & I GOT MY $ BACK ALONG WITH AN APOLOGY.

Without knowing what State Agency or branch of Law Enforcement it will be difficult answering your question in a degree of certainty but , in most States, Provinces, and/or Parishes, when money in the amount over $500.00 is confiscated, a receipt is given to the holder upon taking the money from them. Unless asset forfeiture proceedings have been filed and especially if it was cash that was confiscated, then the return should NOT! take 30 days. The cash is supposed to be logged in the correct increments ie; 5-$20s, 10-$50s etc. and placed in a vault until a determination was made. If in the process that money was to pay bills and you incure any late fees and as you state, you were released without charges being filed and the arrest was not associated with drugs then the department is responsible for any and all late fees during the period of which they unlawfully withheld your $$$. A word of caution though, If you lean to hard, they may invent something to charge you with just out of spite. IT DOES HAPPEN!!

Sorry buddy you are never going to see that money again. Why you ask, well because you have to prove that you had 1300 on you in cash and that they took it. The question is why would a person carry 1300 bucks on them unless they were a drug dealer....you didn't convcted of anything so i say you cut your losses.

Go to their internal affairs, and if happens to be a small department, then go to the state police and request assistance. The reason I ;mentioned if its a small department, is lthat many times (not all ) the officers all know each other they use the good old boy mentality.

Upon release, the police are suppoose to return what they confiscated from you.I would talk to a lawyer.

It is unfortunate but many police officers today are not what they once were. It seems that many police officers are basically criminals with badges.

I would venture to guess that you helped pay for the police officers mortgage.

Nobody is going to be able to answer this because you give us no clue where you are in the world.

I can't even be sure you're in the US, as other nations' currencies use $ as well.
