Depends on the size of the truck, Toyotas with bucket seats can only carry two people legally,but a Toyota with a standard seat could carry three. The best way to know if you are legal is to count the number of seat belts in the vehicle, front and back.

I live in Texas where everyone owns a truck, and although we have a seat belt law, the rule of thumb is as follows:

fat guys - 2
if a girl is present - 3 (she sits in the middle)
Hispanics - 5 or 6

there has to be a seat belt available for each person occupying the seat, one person per seat belt.

the truck me and my buddies are field beatin, its a 83 chevy truck and we have fit 4 of us in there, single cab
