This is the scenario:
Joe had a baby with Mary. Mary abandoned all parental responsibilities and Joe was awarded sole custody of the child. Mary was ordered by court to pay child support (but hasn't been paying)
3 years later Joe meets Jane and gets married. Jane adopts the child. Does Mary still have to pay child support?

Just for the record, I am not referring to myself as Mary.

Mary has had her parental rights taken away from her; it's seen as child abandonment. She would not need to sign any papers in order for Jane to adopt.

Additional question: What if Mary isn't working and is on social assistance? Does she get exempt from paying her child support (including the amount she is in arrears?)

I am in Canada...As far as I understood that if that child is adopted the parent paying support does not have to pay anymore...but she would have to pay until that child was adopted. In Canada we ahve a family maintenance enforement program...where if the parent that has to pay...forwards the money to the maintenace program, and they log it and send it to the parent. If you don't pay it is also logged...they can really mess you up for non-payment. Tehy can stop you getting a drivers licence or a passport, or even car insurance.

she at least owes the support that sheis in arrears for, but i am not sure about now that joe and jane are married, my guess would be that yes, she may have to pay until the baby is 16-18. you could go to your closest court house and get info for free from the family court information room. all the best with this, hope i might have been a little help with this........i am a female and i tell you, i don't know why more "dead-beat moms" aren't put out there to be critisized as is done with dad's.....i hope that all works out for you.

No, because in order for jane to adopt, mary has to relinquish any parental rights and sign wavers in court. However, she still has to pay any back payments she missed, PAY YOUR CHILD SUPPORT! Don't be a deadbeat parent.

newborn help in Canada is a % of the mummy and father earnings. trust me it is a very honest thanks to proceed. in the adventure that your dad's earnings is going up then the newborn help will too, if his earnings is going down the newborn help will also bypass down. the money a dad supplies as newborn help would properly be spend through the mummy the way she needs, besides the undeniable fact that that is assume to bypass for costs touching on to the newborn she does no longer ought to report to anybody what she easily does with the money.
