...also an accomplished artist / illustrator, could he or she be arrested for drawing pictures of nude kids strictly from their (admittedly sick) imagination? I mean, just totally making it up, with no kids used as a model, and not working from an actual photograph. There would not be an actual victim, so how could it be child porn?

Yeah, I'd probably punch a hole through a sicko like that with my fist, but could the law do anything about them?

there is such a thing as a victimless crime - but i think that as long as the 'artist' kept the drawings in his home and did not show anyone else or put them on the internet there is nothing the law could do because he hasnt exploited anybody. but if he did put them on the internet or show them at an art show there is a chance that his representation would be the likeness of a child that does actually exist - and the parents of the child could file a lawsuit for using the child's likeness in a sexually suggestive manner. good question by the way.

For starters, not enough info. You can't call someone a thief unless (1) there was a conviction. (2) you were a witness to a definite act of theft by that person.
You've told us he /she has been convicted, or you have witnessed or participated in that act, albeit unwillingly. Which? If he/she has not been convicted, as an artist they may have work related projects you know nothing about. Drawing nude pictures of kids for gratification purposes is not a healthy activity and surely twisted. Regardless, the least that could be said of those drawings is that they would be used as circumstantial evidence if a criminal
charge was ever laid .

That is a hard answer. i have never heard a law against art child porn. What if what someone else thinks of child pronogaphy is art to him. Like that pictor on rotten. com of a preacher at a church getting head from a small child, i though that was sick but the church thinks its a child loving jusus.
