my 5yr old son has known his stepdad since he was 1 he calls him dad, He has no contact with his real father. It would be nice if he could adopt him. How do you go about it and do you need permission of the real father, do you need to pay and do you need a lawyer. anybody had this done.

Cant wait to hear from you all. Thanks

Bracknell Forest Council's website has a lot of detailed information about Step Parent Adoption.

If your sons birth father has parental responsibility, it is likely that he will have to give his permission for the adoption. The court can decide in certain circumstances (absence for example - so that should be fine) that the absence parents approval isn't required.

The court will also expect you to have considered other alternatives (see: http://www.bracknell-forest.gov.uk/living/liv-children-and-families/liv-step-parent-adoption/liv-alternatives-to-step-parent-adoption.htm for details)

You will need to find a solicitor who specialises in children and family law. You will find details in the local telephone directory or the Yellow Pages. Most solicitors offer a free 30 minute session, where you will be able to ask questions about cost etc.

Hope this helps!

I am almost sure you will need the permission of the biological father for your son to be adopted by his step dad & you will also need a lawyer to help you with the legalities should the bio dad give permission. If he won't or you can't find him, you can legally change your sons surname by deed poll, therefore he can legally carry his stepdads name at the very least. Hope this helps

You will have to locate the biological father and have him sign over his rights. Then you will have to have a lawyer to make all the legal changes and file it with the courts to make it legal. There will be fees and they are not real expensive. You will have to change social security and birth certificate this is why you will have to go through the courts. Good luck.

your child needs to be known as your partners second name first like at the doctors at nursery ext
after that go to see your health visitor and she will give you the forms.it is harder if the Fathers name is on the birth certificate if it is then you have to get his permission first unless he has not had any contact in that three years. I'm going through the same thing i have only another year to go.well done to your partner its nice to see these things..good luck and hope everything goes well

the bio father has to sign away his rights. Go to your court house tell them you plans, they will mail him a notice and he has a certain amount of time to respond. If he doesn't then it's the same as signing away. Talk to you court house though. I don't think you have to hire a lawyer. But, it could protect you.

I have not been through what you want to do, but I wish you all the luck in the world.

I did find a website dedicated to the topic of step-parent adoption:

http://step-parent.adoption.com/

Good luck !
