Before i am working with a company in u.a.e.now i cancelled frm there and start a new business.now i am in trouble that my prvious co. take a visit visa in my name.so i cannot take a resident visa.some body can help me in this matter?

Make sure that your previous company has taken an employment visa in your name. As per the UAE immigration law you will not get a new employment or visit visa if you have an existing residence permit or employment visa.

In your case, as you mentioned, your previous visa has been cancelled already. So there is no any problem for applying the visit visa, it is normal. I would suggest you to contact the PRO of your previous co. to clarify this issue. Meantime check the reason for rejecting your new visa application. Try your best.

your visa was given to you based on an employment with a company ...........therefore you are now illegally working on your own ...........

The Labour Law is protective of employees in general and overrides conflicting contractual provisions agreed under another jurisdiction, unless they are beneficial to the employee.

The Ministry issues a model form of labour contract in Arabic which is widely used, but other forms of contract are enforceable, provided they comply with the Labour Law.

End-of-contract gratuities are equivalent to 21 days' pay for every year of the first five years of service and 30 days for every year thereafter. The total gratuity should not exceed two years' wages.

Employees are entitled to pro-rated amounts for service periods of less than a full year, provided they have completed one year in continuous service.

Employee Relations

Trade unions do not exist. In the case of a dispute between employer and employee, or in interpretation of the Labour Law, the Ministry of Labour and Social Affairs will initially act as an adjudicator. If a party wishes to appeal any such decision, it can take its case to court. Strikes and lockouts are forbidden.

Remember always that you are a guest in a foreign country. Behave in terms of the rules and customs, and respect the locals in their own country. Behave like a guest, not as if you own the place. If you follow these simple rules, you will be treated like a guest.
