Hey all, I live in Portland, OR, and I just got my first speeding ticket on I-5 near woodburn. I am 20 years of age, and have had license for last two years. On the ticket, I have a court date set, and I plan on going too. Ok now the thing is that I was speeding. Going about 95mph, but I didn't see the cop's car till I got near (behind) the car, and then slowed down to 60 mph, and then he pulled me over because he "saw me speeding in his rear mirror." He gave me ticket of 150$, but when he flagged me, I was going 60. On the ticket he wrote 85mph, and next to it, there's a box that says, "laser, radar or pace" and he didn't check any of those. Do you think I should get away with it? What should my argument be? HELP!! I AM FREAKING OUT LIKE CRAZY!!

Trying to catch a sale at the Company Outlet Stores? Why were you going so fast? If he sees that you are going at an abnormally high rate, they can pull you over without taking a reading with the radar.

Like always, you do have the opportunity to fight it over a technicality, but you probably won't lose it. More than likely, you'll have to pay it.

There is always the possibility that if you plead that you're young, you made a mistake, and since it's your first, you may get it reduced, but I doubt it.

Check with your insurance agent. Speeding tickets don’t usually go against you to raise your insurance. If your insurance company says “yes they do” then take defensive driving to have the ticket dismissed from your file.

Usually there are court costs to fighting a ticket. Anywhere between $40.00 - $300.00 here where I live.

You can get with the CITY ATTORNEY and he might cut ya a deal to make cases go faster.. A lot of times they will. Sometimes it’s like. “Pay $60.00 paperwork fees and we will drop the ticket(s).”

If you want to try and fight it then you will need the cop on the stand. (If he shows up.)
You will want to ask him how he figured out you were doing 85MPH? If there were other cars around and he was driving in a lane how does he know for certain that it was YOUR car he pinged.

If he did not use a radar detector you can ask him, “How can you tell someone is doing 85 mph VS 86, 88, 72 mph while looking in a rear view mirror?”

Administrative errors on citations won't void the ticket, the judge will simply have the officer check the box.

Can you be "radared" from the rear of a patrol car that's moving? Yep, all it takes is a flip of the a switch. The officer will cite you for the speed shown on the radar's readout.

Can you get away with this? You have no real defense. Your only hope is if the officer does not show up for traffic court. If he does, You are toast.

This is just a speed ticket. It's a misdemeanor offense. Everybody gets one. Don't sweat the small stuff.

It's your word against his. I strongly suggest you go to traffic school. You can do it online in about 3 hours for about $20. If you still want to fight, go to traffic court just as a spectator and listen to what goes on. I think you'll quickly change your mind when you hear your argument 5-10 times.... Good-Luck P.S. He didn't not check a box by accident, He didn't radar, lasar, or pace. He will argue his experience, years of service etc. if ;you fight and lose it goes on your driving record and if you happen to get another ticket in the next 3 years be prepared for a major increase in insurance rates for 3 years....

just pay it. YOU were speeding and you deserve it. What if you hit someone and killed someone? Let this be a lesson to you! I lost my best friend to a lady that was speeding and her car went out of control. You should not be able to get away with this. And how do you know he didnt chek your speed? Maybe when you slowed down he checked you and you were at 85 like he said

No, you shouldn't 'get away with it'. If the officer clocked you at 85, then he more than likely had you on RADAR at 85. His mistake in leaving the box unchecked does not void the summons. He can absolutely still get you on RADAR even if you are behind him.

I would pay it and be glad he didn't get you 10 MPH sooner.

I dont know about Oregon but 75 to 80 percent of tickets contested in Massachusetts are overturned most cops dont even show up unless you were a wise as* to him so you should beat it especially seeing that he didnt specify the form of detection,good luck and slow down

It doesn't matter if he didn't mark what he got you with on your copy, it's the turned in copy that counts. Just pay the fine and take defensive driving so your insurance won't go up.
