I got married in 2002. In March 2003, I went for interview, and the officer told me he had to check with his supervisor if I had to find another sponsor since my husband income was not enough to support me. Since then I have heard nothing. Immigration says it is FBI process... but maybe my husband stopped the process because he was upset with me?

Immigration says it is FBI process...

Your problem is with the FBI name check.
There are three background checks conducted.
1. Your fingerprints are entered in the FBI database to check for convictions, arrests, and outstanding warrants. This takes a few minutes.
2 Your name, birth date, ssn, A number, and other data are run through the FBI's National Crime Information Center (NCIC) database. This is a complete background check on you and the results are available in couple of days.
3. The name check takes your first, middle, and last names and searches them in all combinations. It also checks your name in different spellings. You might call it the FBI "hooked on phonics"
check. The FBI says that 15% of the names come back as a possible match. Virtually all the time the problem is with other people with names similar to yours. Unfortunately this can only be determined after a manual check which involves searching for documents in 20 different agencies.
The FBI has devoted 125 agents to this task. Only half of them work on immigration cases. This is not their only task either. So actually there are about 60 people working on this part-time. Currently the FBI says they have 25,000 applications that are four years old and have not cleared the name check yet. USCIS receives a million applications for green cards per year and another million applications for Naturalization per year. I don't know how many visa application they get. As 15% of 2 million is 3 hundred thousand false positives per year and they have the equivalent of 30 people working on them anyone can see they will never catch up. Most people work five days a week or about 250 days per year. If each agent could clear up 2 cases per day they would each clear 500 cases per year. All 30 agents would clear
up 15 thousand cases each year. That still leaves 285 thousand unresolved name checks each year. Of course that remaining backlog accumulates. So you can see you can expect to get your green card a couple of weeks after NEVER.

Welcome to the club, you have plenty of company.

Oh yes you can complain to your congressman, senator, USCIS,
and anyone else you like. None of them really care.

The truth is that immigrants are the last minority that it is OK to HATE in this country.

if you still haven't heard back from immigration, its possible your file may have been lost or misplaced....please inquire with the officer who initially interviewed you with regards to your case.....it may also be possible that immigration sent you a notice in the mail and you never received it .....there is one good news i can give you is that when immigration do get your paperwork straightened out and your second interview is done, (assuming everything goes smoothly) you will be given a Permanent green card and not a temporary or conditional one since u've been married to your husband for more than 2 yrs.......

there must be a number you can call to check on your application status. were you dealing with an immigration lawyer at all? call someone, surely it will take a dozen phone calls or so but you will come up with an answer eventually.

It also could be that you are dealing with the government. They never get in a hurry unless you owe them money. I would contact them again to find out. If you don't get a satisfactory answer, write your congressman. That is what they are there for.

So you called them recently and they informed you your case was still undergoing FBI checks???? If not, call them. If you are still undergoing these checks, please seek legal counsel as you should be able to take legal action to resolve this as you have been waiting some time.

All the best to you.
