What does Nascar do if 2 cars have the same number?

NASCAR controls the racecar numbers. Teams apply to NASCAR to use specific numbers and NASCAR decides whether or not the number will be used. I recall hearing after Dale Sr's death that NASCAR rules (as vague as they are) stated that if a number was not used by a team for a period of 2 or 3 years, the team would lose the rights to that number and any other team could apply to use it. They made some sort of exemption for the #3 given its history allowing RCR to maintain the number even though they weren't using it. Like most things in the sport, NASCAR pulls all the strings.

For the most part, NASCAR controls the numbers. There are never two cars with the same number. The teams/owners work with NASCAR as to what car numbers they are assigned or get to use. There is also tradition involved and most teams like "similar" numbers. Example: Robert Yates has 28 (not used right now), 38, and 88 in the Cup series. The 43-45 series was traditionally the Pettys. The number 8 was driven by Junior's grandpa, Ralph, so there is history there. Some teams like small numbers or a number that relates to the sponsor (ex: Jack Daniels using 07).

Teams buy the numbers from NASCAR. That's why Richard Childress owns the number 3. He owns the licensing rights to it, and any drivers who want to say they drove the 3 have to do it on his team. He could sell it, if he wanted to, but he'd have to be crazy...

Dale Jr.'s grandfather, Ralph Earnhardt, drove the 8 when he raced. Dale Sr. bought the number when Jr. started to drive so he could drive it.

I really don't know how the cars get numbered, but you won't see two cars in the same series with the same number.

Nascar drivers have a wrestling contest when two drivers both want the same number. Whoever wins gets it.
