Ermmm, tricky... I'd imagine that the insurance companies would see it as the fault of both of you. The car parked illegally because it shouldn't have been there, and your fault for not taking enough care to avoid it. They may see your side more favourably seeing as though, had the other car not been parked illegally, the crash wouldn't have happened, but I'd imagine they'd fault both of you. Sorry if that wasn't the answer you were hoping for.

Yes, I would say you are still at fault for hitting the car even though it was parked illegally.

Okay, first of all, you hit a parked, unoccupied vehicle, OF COURSE you are at fault.Just because it was supposedly illegally parked, it did NOT give you the right to declare open season on it and smash into it! Secondly, the owner of the truck has NO obligation to provide you with his insurance information. In fact, his insurance status is completely and totally none of your business because it is irrelevant. If you want the cops knocking on your door, than keep being a stubborn little child. Because that's what's going to happen if you keep playing power-trip games with this guy. Either that, or you're going to find a court summons stuck to your door one of these days, very soon.

Its both of you all's fault. The first car should be in the fire lane and you shouldn't have parked in the fire lane and backed into the car. You should have just went and founda parking space, even if you were going to run in for a min.
