I heard that there are different procedures involved in the paperwork as well as her not returning to her country. Is this true and what are the differences?

Every year American servicemen and women get married to foreigners. There's nothing unusual about it. I doubt many get married to illegal aliens, but that's not the point.

You'll discover that the law works for you the same as everybody else whether in the military or not. Same paperwork, same procedures.

She's going to have to leave the country and you will have to petition her.

Unfortunately no special rules exist that allow those who risk or lose their lives in service to our country to allow their wives (or widows) to remain in the US. You must follow the laws and procedures that apply to everyone else. If your wife entered legally on most types of visas, she will probably be able to adjust status through marriage to you, but if she entered without inspection, most likely she will not be able to adjust status and will have to proceed abroad to apply for a waiver of inadmissibility. She will probably be out of the country for the better part of a year while you go through this process.

Rather than taking the advice of people on Yahoo Answers, I would seek the advice from people in the legal department of the branch of service you are in. DO NOT risk your career in the U.S. Armed Forces or you and your fiance's future together based on advice you may receive here. If anyone encourages YOU to do something illegal, don't do it. Yes it is true. As the regulations are now your spouse will not be eligible to adjust her status in the U.S., she will have to apply for an immigrant visa abroad, usually in her country of birth, but her problem is once she leaves the U.S. an automatic 3-10 year bar of returning kicks in. She will have to apply for a waiver of inadmissibility (I-601) with a letter that explains an EXTREME HARDSHIP to you, in order for the waiver to be granted, this does take time and she has to wait for approval out of the U.S., your serving your country in it's self will not be sufficient.

As far as I know, just because you are married, your ILLEGAL spouse doesn't get special treatment and they aren't an automatic citizen. Sorry but I don't think ANYONE should get special treatment.

What part of ILLEGAL don't you understand? You are a hero. Don't do something stupid. Have her do the paperwork PROPERLY before you get married.

the law of immigration changes almost on a monthly bases, so if I were you, I would get a immigration lawyer involved in it
