He has T.P.S. now and we have one chiild 8 months. We have been married for two years in July.

Where is he from? If he's from El Salvador then Temporary Protected Status was rescinded and he has to go back. (You should check if he's from another country and see if TPS is still valid. The Employment Authorization Document may be current but TPS can still invalidate it rendering him deportable.) You can then apply for an immigrant visa to bring him to the U.S. One option is to request a visa to Mexico and have him go there instead of all the way to his native country.

It depends on how he entered the US. If he entered on most types of visas, he can adjust status without leaving. If he entered without inspection, then consult an attorney, because your options depend on a number of things.

sorry but, kiss him goodbye, have him go back to his home country and start the paperwork THERE. Just because you are a citizen doesn't automatically make him legal
