i'm 16 years old. will this stay in my record? i'm from new york
the reason that i punched her was self defense but the law doesn't see it in that way

It will be sealed when you are 18. You can go back into court and have it purged from the books. The only time it would be accessed is if you wanted a security clearance for a government-type job. Then they are permitted to check all the way back to the cradle.

Oh, and find another way to settle your disputes.....

There's a couple things that are in the legal definition of "self defense"--

1) Who swung first determines the reality of the threat to your safety.

2) The magnitude of the treat- was breaking her nose necessary force? Could you have defended yourself with less force?

Even if she hit you first, but you used "unnecessary force" (too much), you would still be guilty of assault.

Say I get attacked. The attacker is a guy (I'm a girl, 5'3", 125lb). I am somehow able to incapacitate him and get away. So far so good, but if I stay and start kicking the crap out of him, AFTER I've secured my safety, that part would be unnecessary force. I've stopped defending myself, and become the attacker.

It will remain in your juvenile record until you are 18. It will then be sealed, and you can forget about it. You will not have to list the infraction on any job application, and it is not visible on public records searches.
Any arrests or trials after you turn 18 will remain visible for life, unless you convince a judge to seal the records for a case.

When you reach 18 you start off with a fresh slate. You juvenile record will not count against you, but try to excercise more restraint in preventing confrontations if possible.

It'll be dropped when you turn 18.
The court only sees it as self defense if she hit u first.
Assault& Battery?!?..I can't believe ur parents/friends let u stay in jail for two weels!!

It will remain on your juvenile record. But those records are sealed when you turn 18. They don't follow you into adult life.

Well if it was self defense. Then you shouldn't have had to go to jail. If you told them it was self defense and they dont beleive it take it a witness.
