i have a codusty case filed in west virginia by my daughters father bother her and i live in illinois would anyone happen to know a link to a page or the laws or guidlines to west virginis out-of-state visitions... right now he is seaaking visitation every weekend starting at 4 pm fri ending 6pm sunday we meet half way ... the tital drive from his house to mine is 10 hours which would get my daughter to his house or mine close to midnight if roads are safe to travel at normal speed and also a total of 20 hours in a 50 hour time frame would be on the road... i suggested he have her 7 to 8 straight days each month since she is only 2 to limit the time shoudl would have to spend in a car..he dont care for that idea.... heck if i went for the every weekend in a month time she would spend over 80 hours in a car that is nuts so any help would be thanks many times over

I am not sure of all the facts of your case. But I do know that no judge is going to expect you to drag a child back and forth from Illinois every weekend. There are specific visitation rules in West Virginia. They are not every weekened or even every other weekend like they are if you are living in the same area. Call the courthouse in the county he filed and ask that a copy of the visitation rules be mailed to you.

Maybe I misunderstood but did you say your daughter's fathers brother which would be your daughter's uncle. Why would he have any rights to visitation? Especially having to go back and forth and the child being only two. I have heard of grandparents having visitation rights but not an uncle. Does he pay any support to you or your child if not I would call a lawyer and just double check to make sure, but I don't think an uncle has any visitation rights. Good luck..
