I had a misdemeanor charge from 1997-1998,but thought It was cleared, now my recruiter saidi he got a call from MEPS, stating that it was not cleared up completely, that I still had some community service hours, I had to complete. My recruiters are trying to see what they can do. Could I be discharched from joining the Navy, now? .......................

They might until you clear it up and then re-enlist you after it is settled, or if it gets settled before your ship date that might be all it takes. Remember it is a mistake on their part too for not catching it so they will try to fix it quickly and quietly.

Sounds to me like MEPS screwed up on this one.

When your recruiter builds your packet to go to MEPS, he does background checks. Then MEPS runs the background check again when they do the paperwork - for most people, this brings up charges and convictions from many, many years back along with their dispositions. (We had a guy who had a charge from the early 1970s when he was a teenager - he didn't even remember it!)

If it went all the way through and you've signed your contract and have been sworn in, MEPS screwed up somewhere because they didn't catch it.

I would ask your recruiter to look into this. I don't think that this would get you discharged, but with MEPS you really never know. Sometimes I get the feeling that MEPS is actively trying to keep people from enlisting.

You may want to be proactive and get in touch with the police department where this charge occurred and see if there are any records that show whether you've completed your community service or not.

Bummer - life can be so complicated.

You might be able to work with the original jurisdiction, the Navy, and perhaps a lawyer to get a waiver on the remaining sentence and move on. Don't be afraid to make some phone calls to the Navy and/or the court.

How about your folks? The military really hates to get too much pressure from parents and might step up to the plate with a little more help if your parents get involved.

Try going down to the Clerk of Courts or whatever they call him/her there and see if you can get a sympathetic ear - they can smooth a lot of things out because they really do a lot of filtering and processing for the judges.

You asked this already. The answer hasn't changed.

You CANNOT enter the military with any pending criminal or civil case against you. They'll put you out of the Delayed Entry Program.

Clear it up ASAP. Contact the DA and tell him you're enlisting in the military and discovered this case is still pending. Ask him what you need to do to close it out fast. Odds are he'll cooperate with you.

It doesn't sound all that serious that they would consider a discharge. If it is determined that you deliberately tried to hide this from MEPS in could mean disciplinary action, however it was a misdemeanor to begin with, so how much attention does this really deserve!

Probably not. You have taken the oath.
You can probably set up some time to
do your community service, before
you have to go to boot camp. Being
discharged is serious business...
I think the Navy will help you out.

No, probably they will delay your entry date until after you complete your community service. I mean the military has accepted certain felons into the service.
