they say ihave to pay it back from 23 dec as i was claming as a lone parent but they will back date my partners claim for me and the five children to 24 dec how do i pay this back none of us are working

I think that all may not be as bad as you think. One benefit will stop on 23rd December but the other benefit [for a larger family!] will start on 24th December and I am sure they will take one from the other. If you did not hide anything there will be no hint of any trouble. Go to CAB and take all the papers with you

If you are not working and someone is claiming benefits (INcome Support or Jobseekers allowance) you should be able to pay a small amount back each week so that you don't use your vital income. This option should have been offered to you.

I would advise that you write down a detailed list of everything that you pay for on a weekly basis. Don't forget to include things that you pay monthly ( to get a weekly figure x12 months and then divide by 52 weeks to get an acurate amount), remember things like the TV licence, laundry, gas, electric, travel costs etc.

If they ask for too much back each week, you can go back to them and ask them to look at the figures again and show that you can't afford it.

If you informed them when your partner moved in but they didn't act, you may be able to argue that they are at fault. You will need to be able to prove that you called. Phone bill perhaps??

A similar thing happened to me, and despite letting them know, they landed me with a huge bill that im going to struggle to pay off.This happens to loads of people.Get in touch with your nearest citizens advice bureau, theyre really helpful.You can also appeal against their decision, but must be able to prove that they were in the wrong, which is often difficult.good luck

So you tell them- by phone as they take weeks to stop the payments if you write. Then they will ask for it back. They will allow you to pay back what you owe in installments over a year- if you ask.

Declare it to the DSS, you will be asked to pay it back and maybe prosecuted if it's gone on a long time.
