I never filed my states taxes for 2005 (I live in Montana). So I know I should get a nice return if I can file them. I already filed my state and federal taxes from 2006 and got my return. Can I still file my state taxes for the year 2005 even though I already filed for a return for my 2006 taxes?

Yes you can still file. The time limit is three years. Expect a penalty for late filing and some interest. Get with it so you can get your refund for 2005. I live in Montana too. Great Falls.

You can still file your 2005 tax return, chances are if you did not owe money this year you will not owe money for 2005. If you do not owe money the fact that you filed late, or not at all, is not a problem. Our government just wants money and would prefer that you did not file if you were to be rewarded a return.

You don't "get" a return, you FILE a return. You might get a REFUND, but NOT a "return".

You can and should file your 2005 tax return. You'll get any refund due. If there is a tax balance outstanding, you'll probably have penalties and interest tacked on for late filing and late payment of tax.

Contact your state tax board and ask for the 2005 forms if you don't already have them. Your refund will probably be reduced some for late filing penalties, but it beats not getting your refund at all.

If you expect a refund, absolutely you need to file. You can't get a refund due to you unless you file a tax return in order to claim it.
