I have a friend who is barely out of Basic Training in the military. She is considering going AWOL. I am unsure of what her punishments could be. She is non-deployable at this time, and is still going through training. I think she just needs a break, she seems to be of mental instability. What actions could be taken against her?

awol is awol if she leaves and is gone for 30 days or longer shes a deserter. she signed that contract she needs to honor it. if shes that stressed and burdened she needs to talk to her chain of command and ask for help. if she goes awol she will face jail time as well as a dishonorable discharge that will haunt her for the rest of her life.

If she is under her first 6 months....read my best answers;how to get my wife out of the military. For short, she can go if she wants. It sounds like she wants her break. The best of us don't get them when we need them, but we still strike fast and kick as_s.

The LEAST she will get is an Article 15. Try to talk her out of it. She needs to fulfill her commitment.

She can be charged under one of TWO Articles of the UCMJ if she leaves without authorization.
Depending on her REASON/INTENT for leaving, she can be charged EITHER under Article 85 (desertion) or Article 86(unauthorized absence). The amount of time she is gone has NOTHING to do with which charge she can be hit with.

ART. 85. DESERTION
(a) Any member of the armed forces who--
(1) without authority goes or remains absent from his unit, organization, or place of duty with intent to remain away therefrom permanently;
(2) quits his unit, organization, or place of duty with intent to avoid hazardous duty or to shirk important service; or
(3) without being regularly separated from one of the armed forces enlists or accepts an appointment in the same or another on of the armed forces without fully disclosing the fact that he has not been regularly separated, or enters any foreign armed service except when authorized by the United States; is guilty of desertion.
(b) Any commissioned officer of the armed forces who, after tender of his resignation and before notice of its acceptance, quits his post or proper duties without leave and with intent to remain away therefrom permanently is guilty of desertion.
(c) Any person found guilty of desertion or attempt to desert shall be punished, if the offense is committed in time of war, by death or such other punishment as a court-martial may direct, but if the desertion or attempt to desert occurs at any other time, by such punishment, other than death, as a court-martial may direct.

ART. 86. ABSENCE WITHOUT LEAVE
Any member of the armed forces who, without authority--
(1) fails to go to his appointed place of duty at the time prescribed;
(2) goes from that place; or
(3) absents himself or remains absent from his unit, organization, or place of duty at which he is required to be at the time prescribed; shall be punished as a court-martial may direct.

She better straighten up or be ready to pay for her actions.

She will be evaluated, and if she is found to be mentally unstable, and not just faking it, she would most likely be cut loose.
