Your policy should have a portion that insures you against uninsured motorists. You should have received a breakdown of the coverage amounts and the cost to you when you bought your insurance and every time you renew it. This is usually a part of the minimum coverage required by law in most states.
Your insurance company will take care of the claim and go after the uninsured motorist. They will not necessarily raise your rates either. Last year my car was stolen and wrecked. OK.... i dont know where two of those posters lived at... or if they live in their own fantasy world... but U.S. insurance companies dont just have a "magical fund" for when you get hit by an uninsured driver. That sounds like something that someone would call into my company about and insist there was and scream at me when i told them it didnt exist.
What you might possibly have (if you elected to carry it) is uninsured motorist coverage. This covers your injuries and acts like the bodily injury portion of the claim IF they had insurance.
If you did not elect to have this coverage your only means of compensation is to go after the other driver directly. As they probably dont have much money (carrying no insurance and all) you will likely never see a penny from them. But worth trying i suppose..

As already said , (THIS IS A UK QUESTION) - there IS a fund specifically for paying out when this sort of scum hits an insured driver. If you were injured - and the police WERE involved then start a civil action against them - or try one of those 'accident helplines'. If sueing for personal injury - the courts also have a fund for paying out when chavvy, unemployed scum injure the public.

Cant remember what its called,im sure someone else who answers will know.
P.s. you claim from your own insurance and they get the money back from the fund.

You can sue them and probably win, then you have 10 years to collect. Through wage garnishments and things like that - life ain't fair - I bet you had insurance! You should add uninsured motorist coverage (it is cheap and covers you for cases like this)

If you're fully comp, claim through your own insurance company.
If not, legal action is a way out.....there is no safeguards, except fully comprehensive.
