I live in Australia and have paid solicitors, and estate agents a small fortune, so any VAT I can get back will be a bonus!

I'm afraid not. The criteria for reclaiming VAT when paid by someone outside the UK is - where was the service provided? If it was in the UK then you are stuck with it.

In the UK I couldn't reclaim any VAT on an estate.... with my solicitor charging £200 and hour and dragging it on for 5 years.. I'd have loved to reclaim VAT.

I guess your talking solicitors bills ect ? I think only if your doing it through a company which is VAT registered can you reclaim VAT on purchases against sales. No one deals with someone's estate through a company I shouldn't have thought. May be different in Aus.

VAT is a tax which passes the vat on to the end user. Only registered businesses can claim vat back and then only for business activity which is rated for VAT, The answer is a definite no.

Ronald S has hit the nail on the head. Sorry, but there is no entitlement to a refund. If there was, every estate would simply ensure that the executor was outside the EU. Swiss banks would have another never-ending income stream!
