My husbands last paycheck was garnished because the student loan place claimed he owed money. They called him and let him know it was current now and up to date (After taking over 550.00)

This time around payroll has stated that his paycheck is on hold???


Why is this. Are these a$$holes going to try and take it again or is it something to do with his company. He is still currently emplyed there

We recently moved. I have no idea if this would cause a problem

For the a$$ stating the obvious he had contacted the HR and Payroll department and hasnt heard back yet. I AM LOOKING FOR SOMEONE WHO HAS EXPERIENCED THIS!

No he doesnt have any court orders

When they garnished his paycheck 2 weeks ago it was because his bank, Wells Fargo messed up his payments and he was short 3 payments to his student loan. He went back and forth with them but in the end the student loan place claimed they never got the payments from Wells Fargo. So they decided to garnish his paycheck 550.00. There was no notification from either his place of business or the student loan company that they were doing this

This is the first time this has happened since the garnishment 2 weeks ago. I know all our finances so no he is not hiding anything from me thank you

I worked in payroll but not in CA.

If his loan is not a Gov. loan
The problem is with the loan co.taking out too much money
Check his pay stubs make a list of what was taken out and when make copies send certified to loan company and his place of employment as long as the right amounts have been taken out. That is your back up your proof they took out the pymt. it is up to his employer to prove where the funds went.

Co. like to make you think that you are dumb and like to take advantage of you

I worked in payroll for 12 years and never put a paycheck on hold because of a garnishment. If the garnishment is received in time to process it with the payroll, it is. If the release is not received until after payroll is run, the garnisher will have to refund it to you.

They may think they are doing you a favor by redoing his paycheck without the garnishment. Actually they are illegally holding his paycheck. Tell them to get the check to you immediately or they can be reported.

Usually a payroll check is not on Hold. If there is a garnishment for the loan, the law dictates how much percentage wise is to be withheld and the remained is to be given to the employee. He really needs to speak with the payroll department as they are required to give notice of any garnishments etc. before implementing them. Something does not sound right. Your husband my have another issue that he does not want to tell you about.

I think it is his company. They feel they work for the other company. Was there a court order? There should have been.

I would solve it this way, if he is current do not work through your husband's company, try and get the loan company to handle it. Explain the problem to them. Make these people call your company.

Your question states his pay was garnished. Your first Additional Information states their is no court order. One of those statements is FALSE. IF payroll stated the paycheck is on hold (I doubt they did), than they are incompetent and have no clue what they are doing. The state you are in and you move are both irrelevant.

Did you see this for yourself or is this just something that HE told you.
A garnishment is the result of a legal order.
It would have specifically stated how much money was to be taken.
The job would NOT have held his check.
In fact they would issue him a check with a percentage of the wages taken.
NO way would they have kept the entire amount!

Maybe you should contact a lawyer and ask them and see what they would recommend doing since they would know more about legal cases like this.
