I thought that 1099's had to be post marked by Jan 31 just like W2's. If I am right can you get the company penalized for sending it late and if so, how.

If one is to be mailed to you then you are correct. The company does not have to mail one out to you if they paid you less than $600.

I would call the company to see if they mailed one out. If they refuse then contact the IRS and report them.

They just need to be placed in the mail. Oddly, the law doesn't specify a postmark date requirement.

The IRS will decide if a penalty is warranted. One or two complaints are not likely to trigger much followup action from the IRS.

If it was delivered by 2/15, the IRS won't even take a complaint from you.

They have the same deadline, 1/31.

I'm sure it is January 31 because that's when my husband sent his out to his subcontractors. I am still waiting for one from my former employer. I'd love to find out the answer to this myself!
