i was told by my rental car company the car has a bumper damage , who will pay, my car was rented by the other party who was responsible for my car accident and they rent me a car( while reporting my own car was a total loss). After I returned the car to the renting company and was told the bumper was damage, who will pay the damage, his insurance company or mine. Do i have to pay out of my pocket in this case.

Will you have to pay? Maybe. You are responsible for any and all damages, whether you cause the damage or not, to the rental vehicle while the vehicle is in your possession. When you returned the rental vehicle, if the vehicle was damaged, they should have noted the damage and notified you at this time. If no damage was noted at this time, you are not responsible and while they may dispute this line of reasoning, no damage noted, no responsibility.
If you were notified of the damage when you returned the car, then you are responsible for the total cost of repair. Do you have to pay the total cost? Depends. If you had insurance coverage provided by either the rental company or your insurance policy covers rental vehicles, then you responsible for paying the deductible as required by either of the policies. If you did not have the rental insurance or your insurance policy does not cover rentals then you are S.O.L., you pay big time.

Unfortunately, You will have to pay for the damages through your insurance unless you had purchased collision insurance through the rental car company.
Here's your out, though;
When you returned the car to the rental company, was there any bumper damage? If there was not, then I think the rental car company is trying to get you to pay for damage someone sle might have done.
In the future, it's a good idea that when you rent a car, do a 'walk around' on the car before you drive it out of the lot. Note anything of damage including scrapes, then take it to the rental office and let them know. Then you are covered against someone trying to collect for damages you didn't make.

If you were renting the car with your own insurance coverage.. your insurance will pay for damages after you pay the deductible from your policy.

So now.. you have a deductible for the loss of your total vehicle, AND a deductible for the damage done to the rental car.

This is why (although expensive) it is always a good idea to get the rental car agency's insurance when you rent. If something happens you are debt-free from anything that could happen --- LIKE DAMAGING A BUMPER!

You pay.

Whatever you do to the rental car is your problem. If you still have auto insurance you should notify them about the rental cars bumper. If it's going to cost $350 to fix and your deductable is $500 then you have to cough up the $350 yourself.

The person that totaled your car didn't damage the bumper on the rental, it's not his fault. It's yours.

If the car was damaged while you were in posession then you are the responsible party for the vehicle. Your insurance would be the company to pay if you have the coverage. Contact your insurance company and tell them what happened. They will let you know if they will cover the claim. If not, you are responsible for the damages.

Wait.. your not asking if the person who you previously got in an accident with (the reason your in the rental) is responsible for damages to the rental are you?! Ok, im guessing not.. ill give you more credit then that.

YOU are responsible for the rental you are in. YOUR insurance pays for the damages under collision (usually- some states its different) unless you got insurance with the rental company in wish it could pay.

I don't understand what you're asking, but the bottom line is this...if you rented a car and returned it damaged, you are responsible for payment of the damage.

did you accept the insurance at the rental place. If you did not then your either your credit card would have some coverage for you or your insurance company if you had collision would cover it pending on your state.
