Long story short. Not my fault. The guy backed into my car. It was parked to sell it. So no insurance policy on it. My BF and I were sitting in the car out of the rain writting out a new for sale sign. The car vibrated like crazy when we drove it to move it back to my place. The guys insurance company didn't even check the alignment or add it to the estimate. The other estimates don't even include the alignment. There could be more damage. I decided to get cash to another car. I have not signed anything yet or recived the check. My car is worth about 2K. It wouldn't be worth it to fix it.

361.14 difference. I asked to raise their quote. The Insurance company said no. If I had go to an auto body repair shop of my choice with 1013.76 they would call and ask for them to kick down more money. I am going to notify the insurance company that in writting that I am taking them to small claims court.

Any ideas on the letter that I submitt?

My BF and I were injured. The medical people are refusing to bill the insurance company responsible. They wanted me to pay up front and get rembursed later or have some other insurance cover it. I didn't want to wait. I used my work health insurance. So they are getting the bill.

Any way I can get the Car insurance company billed?

I put a sellers insurance policy on it. I took the car to Les Schwab and they found 250 worth of damage. The axal where the car was hit is bent. The others are fine. If they try to straighten it then it would break on the road. I at least want 1200. I sent this to the adjuster and he still wont increase the amount. The chiropractor also found that we both have the same injuries on the same sides. All of it is medically documented and has been sent to the insurance company.

If you're wanting to cash out, which is what you're saying....you should just quit complaining and take the money. And here's why:

They owe for the damage...if you're not going to have it repaired that's your business, but the full extent of damage isn't known until a tear down is done. They are paying you based upon visible damages, not hidden damages.

As far as the alignment...they don't know it's accident related, and neither do I for that matter, but I'm sure your response is "the alignment was fine before." They only owe for accident related damage. How's that determined? By a tear down at the shop & if an alignment is consistent with the overall damages.

As for the body shop estimates you reference: what do you think an estimate is? It's an estimate of what that particular place will charge--everyone charges different rates for labor, parts, etc. Why should they pay you the highest estimate? Because that's what you want? They don't owe you for that.

As for small claims....go for it. But here's the deal...the judge will award you the LOWEST of the 3 estimates you bring in, and if the insurance companies estimate is the lowest, that's what you're gonna get.

And finally....you can't sue the insurance company--they aren't the ones who backed into you car. You have to sue the owner/driver of the vehicle.

1st the damage to the car. Is the insurance company paying you 100% ? Then they need to find a place where your car can be fixed for the amount they are paying. If they are not paying 100% then they are finding you part responsible for the damage and that is why the money is not enough. If the medical people do not want to bill the insurance company and you are using your medical coverage that is fraud. If your injuries were the result of a car accident then it goes through your car insurance. If the medical place will not take insurance then I suggest you contact the insurance company and go from there.

This is obviously your first accident b/c you seem to have no idea how this all works...


First- all you need to simply do is take the insurance companies estimate to the body shop with you and the body shop and insurance will work out any supplements needed for the estimate. (unless the body shop is unreasonable and charges way too much.) You will be out of this negiotiation.

Second- yes.. you are responsible for paying the medical bills first... when you fill treatment is complete you and the at fault parties insurance will work out a settlement.. it will be the amount of your medicals and maybe a few extra thousand if you have permenant injuries. The law requires the insurance company not give you any money until you sign a piece of paper saying you will not ask for any more money.

Your making this more difficult then it is.

You would not sue the insurance company, you would sue to person who hit you - this is a risk you took when you chose not to ensure your own vehicle, there are polices for "sale" cars that are just comp or collision - what if someone stole the car, or a tree branch fell on it, you would be out with no one to sue!

You cant just bill the car insurance company and dont get a lawyer becuase it's not worth it.
Take the person to small claims court. The insurance company will represent them. Make sure to bring several estimates. You will most likely not even end up going to court. Once the ins co sees that you are taking it to small claims court they will just settle it.
It happened to me and I got them to give me 100% of the estimate plus a rental car when they orignally wanted to give me 60% of my damages and no rental car.
Just make sure that if they send you a check, you dont cash it..becuase that may be considered acceptance

You are NOT injured from this loss. You will be laughed out of court if you are dumb enough to try it. If you hire a lawyer he will take half of the $1013.00 you were offered and do NOTHING.
Are you and your dope boyfriend so fragile that you really had to rush to the hospital after being bumped in a parked car?
Forget I said anything -- go on and get a lawyer and try this in court, deadbeat.
