The best thing you can do is get a doctor to verify that is what caused them to become ill. If the health dept or cdc finds that the makers of peter pan were negligent then you will need proof that your kids were sick. If there is negligence there may be a class action lawsuit and the more info you have the better your chance at some financial compensation.

well if your sure it was the peanut butter and not something else the children ate and possibley lied(i and lots of children used to do that) if your children eat it there is nothing wrong really unless their allergic which is possible and its not peter pans fault the butter was defective it could have been the store's fault, and its not that expensive to mail caps I mean say screw it the money is already even think of how much money you spent buying there butter well i guess its not even but just let it go if you already knew it was the peanut butter then you should have knew that it would go away like the flu and if you didnt know and thats why you took them to the doc and you really need the money back then get the doctor to have a note saying that it was their butter that caused it and then mail it with the caps if you dont get the medical bill money forget it, if you want to go to court they wont go and you'll end up losing and it cost more to go to court and the money it will take to get the needed proof of the childrens sick, there healthy now or will be so dont worry too much! I havent gotten sick from it and i eat it all the time-plus even if you get money from them what do they care the people who own it are probably soaking in a hot tub of $1000 dollar bills.

Yea, I'm just wondering the same thing... 3 kids - same 2111 jars for probably 2 weeks. All running high fevers, stomach aches... doctors, medicines, days off work... no insurance... Some people don’t want to be “those people” but where do you draw the line on responsibility? Am I the irresponsible one, as a mother, for feeding my children Peter Pan Peanut Butter?

If you can prove that:
1. Your kids have Salmonella specifically (as oppposed to a different GI infection),
2. The Salmonella came from the peanut butter, and
3. Your kids got sick from eating the peanut butter before the company announced the recall on the product, and before the expiration date printed on the package
Then you could take the company to court and sue for the medical costs. That's the only way to force them to pay. If you don't take them to court, or you can't prove their product caused your children's illness, they could choose to pay the medical expenses if they are feeling generous, but they don't have to unless a civil court judge says so. Before you hire a lawyer or anything, it's definitely worth writing to the company to see if they'll pay without a lawsuit as there's a good chance they'd rather just pay than go to court, but they don't have to.
With things like this were a relatively large number of people were effected, there may be a class action lawsuit, in which case you'd be notified by mail (assuming you send in the caps, which then identifies you as a member of the effected class), and wouldn't have to do anything but send it whatever paperwork you're given. Depending on the court ruling, you might be re-imbursed for any documented medical expenses, or you might be awarded a share of a fixed amount to be divided equally amount the effected group (or possibly a combination of both types of payment).
Either way, you'll still have to pay the expenses now, and they'll pay you back later. If you want to be able to prove that the peanut butter made your kids sick, you'll need a medical lab to document the presence of Salmonella bacteria in your kids' stool, and in the peanut butter. Talk to your doctor about how to do that (before your kids get better). Don't throw out the peanutbutter.

question the position do i bypass if i imagine my jar has some thing incorrect with it. I ate some peanut butter about a week in the past and grow to be deadly ill for 6 days afterwards. I nonetheless have my jar and it has the 2111 on it yet i dont understand if i basically got here down with the flu without caution or some thing touching on to the Peter Pan. anybody understand an area in Dallas ft properly worth Texas i can bypass to substantiate my jar had some thing incorrect with it?

We really don't deserve anything from Peter Pan. I got sick, my wife has been in the hospital for over a week. But we all know the risks of peanut butter.

I have been wondering the same thing. Five of my children and I all got sick from this peanut butter. Thankfully I have full coverage insurance so it hasn't affected us monetarily but my poor kids are miserable!!!

I hate to tell you this but you're out of luck. Unless your children need ongoing care or have died, no judge will award compensation for simply being ill. Illness is a part of life. Sorry

Yes, they should have to pay for the doctor bills. Honestly, you should really send them a letter explaining what happened, and if they refuse to take responsibility for it, you just contact your lawyer and have him/her give Con Agra a call.
