It is stolen. Technically.
In my country at least (UK) "finders Keepers" is just plain wrong. You have a moral duty to hand lost property of value in to a local police station. If, after several months, it is not claimed - you can get it back as yours.
That said, I left my very snazzy phone/pda in a taxi in Boston last year. The offer of $50 bucks for anyone returning it meant the guy came back to my hotel within 24 hours.

don't you hate that.....you think that people would do the right thing.....but sorry even if you lost it .... its still ....Stolen....and report it stolen...call your service and let them know when you get the police report......what ever calls that person made will be taken off......as long as you have that police report.....that's what happen to me.....

Lost. Unless he personally took it from your body or possessions, then it would be stolen.
