Only the court can decide the sentence. Unfortunately for your bf, rehab is not interchangeable with jail. Under certain circumstances, he may receive a suspended sentence or probation if he agrees to certain stipulations like a drug program. Entering treatment voluntarily may help him get a better plea, especially if he is a minor or it's a 1st offense. Get him a good lawyer. Good luck.

You cant trade rehab for jail time. If a judge gives you probation, rehab can be a condition of the probation. If you get paroled, rehab can be a condition of parole. The judge/parole officer will choose the facility. If your boyfriend is granted probation/parole and fails to complete and rehab his probation/parole can be revoked and he will serve the original sentence. All those decisions are made by a judge upon the original sentencing. He has no say in the matter.
