If we allow my husbands ex to claim one of the children when we have full custody and she only sees the kids for 60 days out of the year, because she is claiming him will she get the child tax credit too or will she just claim him for her taxes? Thanks in advance for your help!

In addition, she only pays $50 a month for the 3 kids support, nowhere even close to 50% of their support. But, our decree states that she claims the youngest.

You cannot "let" the ex claim the deduction. She must qualify.

The non-custodial parent can claim they pay over half the support for a child if they pay child support, if the divorce decree states they get the deduction. In either case it is not a choice. You must follow the law.

No she wouldn't get the child tax credit.

If the mother claims the child, she also gets the Child Tax Credit and Additional Child Tax Credit. The dependency exemption and the Child Tax Credit cannot be separated.

However, she cannot claim the Earned Income Credit or Dependent Care Credit for the child. You will be able to claim those credits for the child even if you do not claim the child as a dependent.

ITS FARE TO LET THE OTHER CLAM EVERY OTHER YEAR A LOT OF PEOPLE DO THAT, DOES SHE PAY CHILD SUPPORT????? WHEN YOU CLAM A CHILD YOU GET CHILD TAX CREDIT. ALL STATES VARY CHECK UP ON IT YOU DO NT NEED NO JUDGE TO LET YOU ITS YOUR DECISION..
