Ok I have been married for over 2 years to my wife who is eligal.She has been here for over 18 years though her mom bought her when she was only 2 years.Anywys i am in the military,and they have Legal here we went to a Appnt today,and they said that basically we cant to nothing.Is that true?.She also siad that she would have to go back to her Counrty for 1-10 years.is that also true?..I am scared for my wife that they will deport her,and she does not have anykind of legal document other than her Military I.d...ANyways.After the class we spoke to this lady who came up to us,and said that lady was crazy since shes only a specialist.she does not know as much as a Immigration Lawyer would.Sh said she was here ilegal 6 monthes b4 9/11,and when she got married to a U.S citizen they gave her a green card later on.What shoul i do?..i am scared that they will Deport her.

If you are a citizen and she is legally your wife (proof through marriage license), then she has some rights. I don't think the government can deport the wife of a legal U.S. citizen; however, I'm no lawyer, so the best idea would be obtain legal advice from a professional. When all else fails, get a lawyer.

First question is: did either of her parents, being a U.S. citizen or Permanent Resident Alien or u.s citizen sibling over age 21 submit an immigrant visa petition Form I-130 on her behalf before 04/30/2001 or did one of her parents u.s. siblings do this for them? If not then some basics of what you were told are correct. Under certain sitiuations spouses and children of u.s. citizens are not eligible to adjust in the u.s. they have to apply for immigrant visa outside of the u.s., but if they were in the u.s. more than 6 months illegally and leave the u.s. for ANY reason there is an automatic 3- 10 year bar of returning to the u.s. So in effect one law states they are not eligible to adjust and another saying if you leave you can't come back. I suggest you try to get stationed some out of u.s. for 2-3 years, have your spouse live on base have the visa application made in the country where you are stationed, submit the required I-601 if approved then she can come back with you. The alternative is do nothing or have her stuck alone in her home country. By the way I have seen a Marine go through this same problem, but he was told by the military legal team to have his wife appear for the visa appt. in Cd. Juarez, Mexico and she is stuck in Mexico because her immigrant visa was denied and now she has to wait and see if they are going to approve her I-601. I think it's a damned shame a person loyal and brave enough to serve his country in the military can't be assisted by the very government he is serving and defending. Good luck you have some hard choices.

get the application for a green card. Whatever country she is from you can obtain this in NYC console. You can also get an application at a local courthouse in some states. file for the application. She's already married so she should be able to get it. They will check and make sure your marriage is real. Ex: living arrangements;daily activities;phone bills;electric, etc. Than the next step is invest in some encyclopedias and get her ready to take her citizenship test which is might I add, a very hard test. I'm american and I couldn't pass it. She will need to take it to become a citizen. They probably won't deport her though unless somebody complains and as long as she has a valid green card, she can stay here indefinitely. But if she leaves the country, it's alot of paperwork to get back in.GOOD LUCK

I am sorry to hear about this. Unfortunetly any person who looks like a foriegn person can be stopped at any time and if they don't show the proper id will be sent to a camp and stay there anywhere from 1 to 3 years until they can deport them. If she was in the military that makes her any american citizen which means they can't just take her. And as a military person I thought they are trying to keep them to make sure they have enough ppl in the military. Your best bet is to do whatever it takes to get her a citizenship asap. If you are married that should help start the process and make it run smoothly. Good luck with all this.

no man you should have got a passport when marrying u because ur an american citzen if she didnt then call immgration offices and everyone is an immgrant in the U.S unless ur a native american then ur an immgrant 2 and also u need to be in the U.S with a green card for 5 years to apply for a passport if she already doesnt have one . She'll have to take a test though

Hire yourself an Immigration lawyer. It depends on the country that she was born in.

Her parents were wrong for bringing her here illegally. But, she is an adult and she needs to make things right. Whatever that might be.

I strongly agree with RICKV.I am also based here on Camp pendleton,and i heard of that situation also.Very sad story.
