Interesting question. If the other twin pushed it, then the law would probably charge them as an accomplice, or aiding and abetting (maybe even harboring a fugitive).

How funny, I asked my boyfriend (a cop) a very similar question the other day, except mine was about a traffic ticket.
There are two girls who are joined from the torso down, have only two legs and two arms but have separate licenses. I asked him who would get the ticket, and he said he would probably be so flustered he wouldn't give a ticket (not if it was a minor thing).
Anyway back to your question. No the other couldn't sue for false imprisonment because unless exigent circumstances exist, both would have to be involved. It would be fairly easy for one twin to stop the other in 99% of circumstances so in essence they would both be guilty, or at the least, the second would be an accomplice or accessory. I guess the exceptions would be if the "innocent" twin was knocked out or of a considerably smaller build than the "guilty" twin as to not be of sufficient strength or size to stop them.

There is a precedent for it in the US.
Chang and Eng Bunker - the "original" Siamese Twins were spared jail (after one brother attacked a man in a bar fight) as the judge thought it would mean false inprisonment for the other brother. Therefore both brothers were allowed to go free.
I don't know if they would still reach the same decision today, though.

Why would the other twin sue for false imprisonment? One twin committed the crime and gets arrested for it. Pretty open and shut.

In order for the one to commit the crime, the other would've probably had to have aided them, or at the very least, done little to stop them. I'm not sure how the other twin's sentence could be different, though.

this is probably one of the best questions i have seen on here yet . I would guess in this day and age that they would probably be spared prison due to human rights but that is just a guess good luck finding out mate
