Technically its a fruit although most people consider it to be a vegetable because its not sweet like most fruits.

Agriculturally speaking it is considered a fruit. Around my house I don't care what you call it tomatoes are an all time favorite in salads, to eat as a snack and the main ingredient in most of the dishes I cook.
If it is considered a fruit but consumed like a veggie then we kinda have an easy way of getting our fruit and vegetable counts. Maybe it could count as both!

Tomato is a fruit but many weight-loss plans that involve rationing of carbs, protein, fat, fruit, veggies & dairy refer to them as a veggie due to the nutritional value in them.

Biologically it is a fruit, but by an act of Congress (in the 1880s I believe) it has been declared a vegtable in the US

Tomato is actually a Vegetable. but, there are many different subcategories of vegetables. there are the leafy greens, the cruciferous, the legumes, root vegetables, gourds, and one of these subcategories is fruits.
