My step-son moved in with us in July 2006 and has lived with us fulltime since then. His mother and my husband were never married and never had any formal custody papers written up. Can we also claim him as a dependent for 2006? What is she claims him too?

He has lived with us since July 2006. His Mother lives in NC and we live in Florida. We have him enrolled in school here and he is with us Fulltime.

It's possible...if you have contributed to the most of his support. You will need to be sure that she does not claim him also. Only one of you can! So be sure to get it in writing and notarized if she is willing to give you the deduction. If she is not, the only recourse is to see an attorney, and depending on the situation, and the age of the child you may not want to go this route.

No. He must have lived with you for more than half of the year. Since he didn't move in until July, you cannot claim him.

You cannot claim him since he lived with her more than half of the year. The rule is that the parent who the child lives with more than half of the year is the one that claims him. That would be her. If you claim him, you can get in some big trouble if the IRS catches it! The only way you can claim him is if you get a written statement (and there are forms you have to fill out and send in with your return) that says that she is not going to claim him and is letting you--which is pretty unlikely since it's like a $3000 deduction.

If he lived with his mom until when he moved in with you in July, then she would have the right to claim him this year and you would not, since he'd have lived with her the greater part of the year.
