I was driving my motorcycle a little crazy one day and did not know a off duty firefighter was following me getting my plate number.
He swears i will get a citation.
Will i?

The off duty firefighter will contact the police and will make a complaint. As a result of the complaint, the police can come and give you a ticket. Any citizen can make a complaint about someone's driving, if they are willing to go to court and they can id the driver and vehicle, then the driver can be charged by the police.
Here in Ontario, firefighters can't hand out traffic tickets.

Unless the Firefighter is also Peace Officer certified, he personally can't issue a ticket to you. He can however report you to local law enforcement and they just might be watching you a little more closely. Depending on how you were acctually driving would determine if it was in fact wreckless driving. In most states there are actually subscales to this offense. If the offense was a misdemeanor then an officer must observe it first hand in order to write a ticket. If it was a felony then the firefighter could place you under a citizen's arrest, and have you hauled off to jail. Either way, watch how your driving, you never know who is actually behind you.

One of two things can happen....

1) The "witness" can file a police complaint and take the case to traffic court; or

2) The officer can write the summons allowing the witness to sign the summons! This is however an exception NOT the rule!

I've always believed that one judges their own character by what they do when others aren't watching! It's unfortunate that you should even display the carelessness of operating the vehicle/motorcycle as you've indicated. For the sake of those that share the roads with you....please drive safely!

he can file a complaint. Reckless driving, in most states, is a misdemeanor so he can make a report. If the police/sheriff files it with the District Attorneys office he would be the witness and would have to testify.

Find your states definition of reckless driving and see if you meet the criteria, or if you were just riding like other foolhardy, inconsiderate, defiant motorcycle riders without regard to the safety of others (part of the definition), or not.

If you don't hear anything within 30 days I'd guess you were off the hook. You must have really pissed him off to make him follow you!!!

a on duty firefighter can't not issue a traffic citation.

And no you can not get a ticket for reckless driving unless the police officer sees it ( or they get it on video)

Now if you live in "hick town" USA it is very possible that they could write you a ticket and BUBA the city judge will fine you anyway. remember they often do what they want, but in real life america no they can't

NO, firefighters have no law enforcement capabilities. NOW if he/she is a public safety officer(a person who is certified in Fire, Police, and medical) Yes, but only if he /she is on duty. NOW what they can do is call the police staion and have a patrol car issue the citation, and the officer will use the firefighters, or any other citizens testimony, in court.

No, firemen are not law enforcement, or traffic control personnel, and so, the CANNOT issue you a citation. All they can do is to report you to the police, and it becomes 2nd hand info, and your word against his.

I listen to police scanner and anyone can report a cni driver. But I think an officer has to observe the cni and then pull you over

It's possible he knows a cop who can keep an eye on you. But they can't release a citation on something they didn't personally observe. He's yanking your chain.
