Or if I burn Mexican Flag in Latino district.?.

NOTE: This interests me only as a legal issue. Hate crime is somewhat tricky. I am not doing that and I have no intention to offend people.

It depends how it happens. If you show intent to cause fear yes you can be arrested for makng a threat and it will be upgraded to a hate crime. I took a course on hate crimes and if you show intent to cause fear and harm it can be used against under the terms of a hate crime. If you just burn the flag in your yard you are fine. It falls under a similar case of a man that was burning crosses in his yard, it was legit and okay. Then he moved it so it was facing a house of an African American family, it was then causing fear and imtimidation and he was arrested for making a a threat. I would air on the side of caution and not risk it. It is very close to a slippery slope that you do not want to risk. Having a hate crime and threats on your record is somethign you can do without.

Two 18 year olds got arrested for burning the American flag, but I think that it was because it was on private property, not because the burning per se is illegal (they were smart students, but dumb kids).

I think that if you burned a Mexican flag in a Latino neighborhood, you'd get beaten senseless (not that you had any sense to begin with) before the cops could find you to arrest you for anything. (I'm not singling out Latinos, just seems like normal human behavior to me.) But I think that it would qualify as a hate crime.

The Supreme Court has ruled that burning the American flag falls under "freedom of expression" which is guaranteed by the First Amendment. Having said that, however, if you exercise your freedom of expression by burning the American flag then I'm going to exercise my freedom of expression by adjusting your attitude. As for burning a Mexican flag in a Latino district, by all means go ahead and do it -- I'll sit there with a stopwatch to see how long it takes the Latino citizens to stomp your @$$.

If you stand in Washington DC and burn an American flag, your expressing your right to free speech.

If you go to South TX in a border town, burn a Mexican Flag, you WOULD be arrested for a Hate Crime.

If it is a crime, then it is illegal. So you can be arrested. As far as I know, it isn't a crime to burn a Mexican flag.

I do think flag burning is a hate crime, no matter where you do it. I am not certain of the legallity, though.

Depends on the context of the circumstances, and the feeling of the officer on the scene.

If you're in a rally against Vicente Fox's visit, probably not.

If you're at a rally against illegal immigration, then it gets REALLY murky.

Most definitely. Some hate crime now are under federal jurisdiction, so be very careful in what you do.
