Yes,
One immigrant court turned down the request but the ultra liberal 9th district court of appeals reversed the decision of the lower court. Just another example of legislating from the bench. Doesn't matter what the people want only matters what the judge wants as he can "interpret" the law any way he/she wants.

The issue was lack of proof. He only stated that he was beat up. Problem with this is it sets a precedence. Now anyone can walk into our court and be granted asylum based on their word alone.

Any illegal alien can and will be granted asylum based on making the statement I'm gay and if you return me to ( ) I will be beat up.

Unfortunately the courts work on case law and bad decisions become the basis and rationale for making more bad decisions.

The absolute most the court should have done is told this man to move to a part of Mexico that accepts gays openly like Acapulco.

Well, I try not to challenge things that I don't know everything about. I don't like it, but someone felt it was appropriate. If the police did harm him due to his nationality and/or sexual orientation, then he deserves some sort of retribution. What better than asylum?

By the way, "police beated him up"? That really doesn't add much to your credibility. . .

no they are bound by the legal system...they must abide by the laws. I find it amazing as to how Americans are so concerned about things such as illegal citizens just as they used to in the past in times of war....read history.....instead of focusing in on the facts....what is going on in the WHITE HOUSE with OUR GOVERNMENT!!! Get a clue.
