i found out i am the father of a wonderful little girl but the mom is still married and left her husband and i have been helping and taking care of daughter she is 15 months,but the husband will not sign the papers for name change and how the mom is taking me to court and to top it off she has a new boyfriend and is stilled married.

I found out I am the father of a wonderful little girl after taking a paternity test, but the mom is still married and left her husband.
I have been helping and taking care of my daughter that is now 17 months old, but the husband will not sign the papers for the name change and have his name taken off the birth certificate.
Now the mom is taking me to court and to top it off she has a new boyfriend, who she is engaged to, and she is still married.

By taking a DNA test, you've taken the first, and most important, step in establishing your legal rights and responsibilities.
I assume that you've already gotten yourself an attorney. But if you haven't and you can't afford a lawyer on your own, then I have two words for you: "Legal Aid." (That's an organization that provides free legal help for those in need.) In any case, you need to have competent legal representation in order to ensure both your rights and responsibilities as a parent.
BTW, before reading all of the sordid details, I was initially very tempted to suggest that the less-selfish course of action for you to take would be to do nothing to interfere with your baby's mother's marriage, because the child's best interests might be served by thinking that her mom's husband is her sole father. But it seems that your baby's mom is messing up her marriage herself. And maybe even she is not putting her child's best interests first.
Given the mom's apparent instability when it comes to relationships, maybe it'd be better for the child if you had primary custody, even. Is that something you'd like to look into? In any case, get a lawyer. A good one. (And even the free ones can be quite good.)

I'm very proud of you!!! You're one in a few guys out of wedlock that will step up to the plate and take care of his actions. That takes a real man to do. You'll make some woman VERY happy one day I'm sure.
On to your Q.
You need to get a DNA test.
I understand that she told you were the father, BUT she was married, and she has a boyfriend now. I don't mean to sound rude, but how do you know she was ONLY sleeping with you at the time of conception?
I don't know all the facts, but from how I see it is you might be the one who makes the most money so she wants you to pay the child support. In my state she would then get 17% of each paycheck. It could be different where you live. (look into it)
Again I find that very honorable of you to want to take reasonability for that little girl, but PLEASE run a DNA test. Find out for sure.
As for the name change....
It's going to come down to her and the husband. Does he know that there's a chance of you being the father?
However, even though you might be, both of them have the rights to her since they're the ones on the birth certificate. You might be able to find a few holes in the legal system if you're her dad.
The best thing to do is contact a lawyer. They would be able to give any and all legal advice that you might need in the next few weeks to months.
From my past experiences though the two on the legal document have the say in that little girl’s life.

Wow! That's a lot to handle. The best advice that I can get is take her to court demand a paternity test, you prob will be ordered to pay child support, but you will get visitation rights as well. DOCUMENT EVERYTHING! and I mean everything how many times you called her you know things like that. How many times you have asked her to see your girl, and even ask her to take a paternity test. That is the only way that you can prove you are the father and get visitation.

You would need proof that the child is yours (paternity test), then hire yourself a good lawyer. Be prepared for a long wait though, this type of case is not considered very imortant in the eyes of the court, since there is really no harm to the child.

All you have to do is prove dna! Then you will have a case. All though you may not be able to achieve full custody you most definately will get frequent visitation!

check your laws out in your state. you are a stand up guy.i wish you all the luck. and you do have rights to your child dont give up keep trying. pray about this GOD hears all prayers.and answers all of them in his time.
