In Florida the possession of 20 g or less is a misdemeanor and could cost your household a thousand bucks and your spouse could win a prison term of a year. But you might want to know that possession of Paraphernalia can cause you do do the same prison term and the same fine. You will also lose your drivers license for up to 2 years. Now when you both go up your kids will be taken away. The chances are the you will not get to that point, your are too smart for that... Right? If your spouse happens to be the one who is with the kids at home and taking care of them, you may lose them, but temporarily. You will have to demonstrate that you are capable of caring for them and that you do not use drugs. A drug test right now might be a good idea for you. So that you can prove later that you don't use. Of course without knowing more about where you are in this situation I could guess and talk for hours. Kids need the full attentions of the caregiver, depending on their age it could be deadly to not have a clear mind while watching them. With toddlers you can turn your head for a minute and they can be out a window or drowning in a pool, add to that the depressed mental abilities of a drug induced state and a minute could become 5 minutes.. could be all it takes to make the difference between life and death. You want to play the odds, buy a lottery ticket, don't play with little ones lives.

Yes. And how is it that you don't know about it? You must have some idea or you wouldn't be asking this question.

There's also a great law on the books in Florida - and I've used it many times to charge people.

"Maintaining a Dwelling for the Purpose of Selling, Utilizing, Keeping a Controlled Substance To Wit: (insert drug name here)."

The first time is a M1. The second time it's a F3.

I talked with someone the other day in Florida, and I believe it is still illegal there. Move west.....

Illegal yes I believe they can take your children away, jeopardizing the kids or something rather? I would go into your state laws and find out for sure. Good luck!

Yes. If you have any illegal drugs in your home and you are caught with them, no matter who they belong to, you cannot prove that you weren't using them too. And that's the way the law looks at this situation. They could very well take your children for a while.

they could be but if he does not blab to everyone that he is doing this and he only does it once in awile and it does not interfere with his parenting skills then you guys should be fine. If someone does find out and tells the social services there will investigate and could lead into the taking of your children. I would just tell him that you would for him to quite because you are scared.

For a first offense, I don't think so. But, it's risky and he needs to not broadcast this kind of information about his life. To each his own I say, but people start to talk and all of that and it's just not worth the ordeal he and you would have to go through if he is caught with it.

I think only if they catch him doing it in the house when the children are there. Even then if he was upstairs or down in the basement then maybe no. Then you may be able to convince the social worker you didnt know.

Yes, they can be taken away - and rightly so. I can't believe that you live with someone who takes dope and you don't know anything about it.

Better clean up your act before children's services turns up at your door.

Sounds like you already do know about it. Unless you have been reported to social services for abuse or neglect, and found to be guilty , then I don't think your kids can be taken from you for any reason.
