Under the UCMJ that is a crime. But since he probably went AWOL because of the Viet-Nam war, and that war ended a long time ago, and your uncle has spent so much time in Canada, I doubt that the military will dare to do anything to him if he returns.

Bill Clinton was a draft evader, which is also a crime as serious as being AWOL, and yet Bill Clinton became the Commander in Chief of the Armed Forces.
