Since I am a plant lover I would buy a cheap pot and soil and re-pot the poor thing. Or if you are not into plants dispose of it or complain to the HOA as you suggested.

Heck yeah! Call the HOA! This is precisely why you pay HOA dues. Let them deal with it. I'm sure it's a violation of one of the MANY rules set forth by the HOA.
Is this mess out in the open for all to see? If so, it's even more of a reason for the HOA to step in!
Plus, I'm assuming you own your condo and have an interest in keeping the property well maintained and free of broken, ugly, dead plants. You pay HOA dues to live in a community that is clean and presentable. Put those dues to use!

You are overreacting. It's a plant, not a pile of garbage. Can't you be a bit more tolerant? If you complain to the HOA about a silly plant, you are going to look like a nit-picking busy body. Then, if something serious does come up, you are less likely to be taken seriously. You'll just be, "that guy who complains about the littlest things".

Maybe you shouldn't have to do this, but I think if it were me I'd either ask "Fred" if he'd mind picking up the plant and explain that you'd like to give the porch a good sweeping; or else I'd just get a cheap pot, stick the plant in it, and put the broken pieces of the old pot in a bag. If he took the bag away in a few days fine. If he didn't I'd toss it.
If you first ask him to pick it up so you can do a good sweep, and if he doesn't, then he'll understand if he finds it bagged up. (If you don't want to bring a cheap, new, pot; put the whole business in a bag that's folded in a way that acts like a tray.)

I've seen condo associations go nuts over silly things like "wrong drapery color" or "unauthorized drain spout". A dead plant, a broken pot, and a pile of dirt, sitting there for months? I'm stunned that you are the only one that has complained. Is it not not visible from common areas? It seems ridiculous that it would get to the point where you have to give him an ultimatium about this, to threaten to turn him in - but it sounds to me like you have indeed arrived at that ridiculous point.

I have to wonder why you're getting all hot and bothered over a plant. If it were garbage or a LOT of clutter, I'd understand, but a single plant??? I'd say you're overreacting; a single plant that needs a new pot doesn't mean he's messy; either way, he's not harming you, so give it a rest.

I think you are correct to be annoyed by this lazy dude! DO NOT mention it again to him or any other neighbors. Call the hoa and complain.... Just try to be neutral to him as you don't want any trouble you just want the plant cleaned up.

i agree that you could call the HOA. if there is a way to do this anonymously, so much the better.
at the moment, he isn't bothering anybody but should he get riled, you wouldn't want to be in the line of fire.
