I live in apartment complex. The people next to me have a dog which barks all day. It has woken me up literally every morning for the last 4 months straight. I work nights, and often work late into the night, so I don't appreciate being woken up every morning at 7am when I don't usually get to bed until 4 or 5 am.

They leave for work every morning, and the whole time they are gone, their dog does not stop barking. It constantly barks from 7am until they return from work at around 5pm (and even then, it sometimes continues to bark)

Sometimes, I go and knock on their door to talk about it with them (when I know they'll be home), but they never answer. So, I have left multiple notes on their door about the problem and asked them to talk to me about it. They haven't yet. I have contacted my landlord about it half a dozen times. Nothing is working.

This dog is making me lose sleep every day. My work is suffering because of it.

I need to take this to the next level. Any suggestions?

Sue the inconsiderate sons of b itches. Have them served with summons. They are creating a nuisance and you have a legal cause of action. Strike a blow for the rest of us that have had to put up with these a ssholes. I feel for you and pray for some kind of justice. I've been there and I know what it feels like. There is legal recourse but the problem is that you will just piss them off and the thing will just escalate even more. In my case, the nuisance dog owners broke the rear windshield of my car. At night. When there was no one around. I knew it had to be them but I couldn't prove it. So, I eventually moved somewhere else, they won. Sue them. Under causes of action, you can list negligent infliction of emotional distress and intentional infliction of emotional distress. Sue them for over $25,000, that way you get venued in Superior Court. Or not. I just think it's worth a shot. Champion people in similar situations.

I went through this problem with my neighbor (along with so many pairs of earplugs) and her labradoodle. It turns out she had NO idea it barked the -entire- time she was gone (starting in the early morning).

I would suggest looking at your apartment's noise ordinance. Most apartments have something about no loud noise from like 10pm-8am (or something like that). It wouldnt be a dramatic improvement, but you have to start somewhere (if it shaves an hour it might last all day). I would then leave a note to explain to your neighbor your situation. Tell them that you work late, and that their dog begins barking when then leave, through the rest of the day. If they are violating noise clauses, let them know (as nicely as possible).
You will also want to copy it and give a copy to your apartment manager so they know what is going on. You will probably want to speak with them about the situation also (they may have special provisions about barking dogs). Talk to anyone living above/below your neighbor or even across (if you have people situated like that) and see if they feel the same. If they do, politely ask them to talk to the manager as well.

If your neighbor doesn't speak with you within a few days, and they are violating a noise ordinance (if your apartment's one doesn't work, look into the city noise ordinance) you can file a complaint. However, unless they ARE violating a noise ordinance, no one can do anything (bound by the leasing contract). You file a complaint by calling the police, they come out and fill a report out and give it to your apartment managers. Most of the time, the apartment will charge per complaint (usually ~$25) but if you get so many, you will be forced to leave (breaks your lease). You can also have other people do this (that's why you talked to them). I know it seems harsh, but if it is bothering you so badly and they are not willing to work with you, they shouldn't be living in a place like that.

Until then, earplugs and earmuffs all the way. :(

I would send them a certified letter asking them to control thier dog and then try and contact the landlord one last time. But since neither one of those will probably work I would contact your sheriffs office and ask them your options. Also you could make a recording of the noise for proof that the dog is constantly barking so the police can take you seriously. IF THAT DOESN WORK, tell the landlord you are going to have to leave if it persists, when people see money walking out the door they typically change their attitude and he might become more aggresive in fixing the situation.

Other than shoot the poor creature, which is out of the question, and because you have already contacted your landlord, and he/she has not resolved the dilemma, I would then go to the next step, and either contact the SPCA in your area or legal authorities. You could also suggest to your neighbors to hire someone to walk their dog, which may help, as this helps this dog to work off energy, and any frustrations.
Last resort? tell your landlord you may move if no peaceful resolution can be reached.
I don't think he would want anyone moving out of his building, and may indeed work to resolve this problem. but I think walking this dog and giving him exercise is what may be the best answer.

The dog is obviously very lonely and bored when the owners are not there. To leave the dog all day on its own it not right, they either have to get good advice on how to address the problem of it's loneliness while they are at work or not keep a dog if they are neglecting it. Also, dogs bark for other reasons too, that something is wrong. If they are not going to listen to you, I think you need to report it to the apartment complex manager and have him deal with it.

Of course. Talk to the apartment manager and complain. I would also read your lease closely regarding your rights in this matter. Also, you can call the cops. There is a noise ordinace law that requires quiet past a certain hour at night. If this person does not obide by that they will get fined. Believe me after they get the rather hefty fine once or even twice they will begin to shut the dog up. And if you keep complainig to the manager and if the manager does not do anything you can complain to the owners of the complex who is in charge of management.

If properly trained, they should also understand whistle and gesture equivalents for all the relevant commands, e.g. short whistle or finger raised sit, long whistle or flat hand lay down, and so on.

It's important that they also get gestures and whistles as voice may not be sufficient over long distances and under certain circumstances.

Call your local police department, there may be a case for noise disturbance.Good luck, I went through this a few years back, it is enough to actually drive you insane because of sleep deprivation.I now have the dog, it was barking from neglect. He has been one of the best dogs I ever had around.

There may be a reason why the dog is constantly barking all of the time, such as lack of water, chained up in his or her own back yard, etc.

I think the best solution is to simply call your local animal control and let them check out the dog that is constantly barking all of the time.
