I am not sure, but if your kids are Americans I think there is a special process the parent can become US citizen. If he is in jail for a felony, he will not be apply for citizenship the normal way. You can try getting marry, and apply after 3 years of marriage. My biggest suggestion is for you to visit a lawyer in immigration. That is probably the safest way to go. Good luck.

First you need to get married or apply for a Declaration of Informal Marriage, then apply for naturalization, then file I-212, then file I-130 and other supporting forms during the process and then when he appears for his immigrant visa at the American Consulate he may have to file a I-601 with a letter explaining EXTREME HARDSHIP to his U.S. spouse and U.S. children. It's gonna take time and money, but he may be able to return in 2-5 years. But he will be deported and he returns illegally and gets caught he face 10-20 in federal lockup.

No, you can't do nothing for him. Please can you tell me what was his status here? Why is he in jail? Is it for immigration matters or crime?
He could probably have the chance to come back into the USA after ten years, even if you become a US citizen!

I say he is getting his just desserts. What were you thinking? I think your best bet is to accompany him with the children to his country and live there. This time, do things the right way. Love does NOT conquer ALL! There are reasons for laws in society.

if he's illegal and he's been here for his whole life...you need to call his parents up and blame them. and make them pay the thousands of dollars it's going to take you to fix this situation. and take care of your kids while you spend hours in line at the appropriate offices...and that's only IF this situation is fixable. and if you aren't a US citizen yet....we are talking YEARS. why haven't you gotten your citizenship?!!! it's there for a reason!! to HELP you and give you RIGHTS!

if your MAN is a illegal aliens going to school and working in USA don't qualify him for a Visa,it only proves. he been getting away with breaking the laws ..

If he snuck over here once he could do it again......but realistically he won't be allowed back here for 10 years...could you possible relocate to his country for those 10 years? Then you could start the process over after they are up

sorry sweety. i feel sorry for u and the kids but this is what happens when u break the law. he knew this coming into the US and before he had those children. u risked it and it happend. i say its about time. now if we could only round up the rest. best of luck to u.
