Yes, if you are caught driving with a suspended license. No, if it is expired. At least that is the way the law read a few years ago.

If driving on a suspended or expired license in your area is on the books as a misdemeanor, then the answer is yes, you can be physically arrested and taken to jail. Police will *usually* just give you a ticket even though they have the right to arrest you and take you to jail.

If the offense is on the books as a "citation" offense (some states call them different things) then you are usually given a citation ticket but not physically arrested and taken to jail. A citation is *still* technically an arrest...but, the police will let you go in exchange for a "promise to appear" in court on the charge. Usually, you don't have to go to court unless you want to fight the charge.

I sure hope so. If you've had yourlicence taken away, you deserve to be thrown in jail. However, i'm pretty sure its just a fine if you let it expire by a few days.

yes, with a suspended license. you are in violation of a court order no to drive. with an expired license, it could go either way, depending on the mood of the policeman who pulled you over.
