I have given him forteen days to vacate the flat, but he refuses to do so and claims rights under the Landlord and Tennants Act
I was not his Landord, the property does not belong to me He pays no rent, council tax, electricity and gas - Can he do this?

The laws differ from state to state. For example: In CA. if the flat was part of the compensation of employment, he must vacate at the end of employment. There is no 30 day wait.

In CA, all eviction/vacate notices are dependent on when rent is paid. If you pay every month, you must be given a 30 day notice. If you pay weekly, you only have to be given a 7 day notice, ETC.

It depends on his manager contract that you had with him. If it is part of his employment agreement than no. He has to move. If he has no contract to be living in the flat and is not paying rent then have the cops throw him out. He is not a tenant unless he is paying rent. If he refuses make him pay a fair amount for the flat plus a good size deposit to stay. If he doesn't want to pay the have him removed by the police.

He is on a month to month rental basis, normally you will have to give him a 30 day notice to vacate the home.

This should have been explained in writing in a employment agreement.

He can still refuse, and you will have to take him to court to get an order to evict him.

but you are his landlord, or your company is, and he is a tennant. By letting him live there are are renting to him free of charge in return for his service.

But of course the value of this rental needs by law to be included in his W2 as value. Just like a pastor and the home he is furnished, the value of that rental is income
