Intentionally, to cause an accident?
I know you should avoid the accident, duh.
I want to know what legal action can be taken against an idiot that would try to cause an accident!

It's 24 hours later and I'm not as upset.
But you can bet I will be on the look out for this guy.

Next time he may kill or injure someone and I will be glad to be a part of putting him away.

I'd broadcast his license number but Yahoo won't let me.

Lay on the horn, avoid the accident, take down plate and car info, report it, have road rage for a few minutes, then calm down and go about my day.

Unless you actually got in an accident with the person, you really don't have any legal recourse. It just boils down to the fact that people are jerks sometimes, and it would be nice to sue them, but you really can't if no damage was done.

At the very least, you could call the police and tell them there's someone driving dangerously and give them the license number. They probably won't do anything about it, but hey, it'll make you feel a bit better.

The best thing to do is have witnesses testify. Other than that an accident investigation is your only other opportunity. Get a GOOD lawyer. The thing that sux about insurance fraud is that it's too easy to get away with it since it's your word against theirs. It's esp hard since you are the one that is rearending them. It's too easy to blame someone to make it look like it's not your fault. I know the boat that you're in, and all you can do is get a lawyer and investigation. Your local police department should have trained accident investigators.

This is a scam that some pull.

Ensure that you make a clear statement in your police report. Ensure that your filing with the insurance company includes a complete account of what happened.

Trust that the insurance company will fairly evaluate the reports and will determine that you were unable to prevent the accident.

Hit 'em, they will be charged with "Attempted Vehicular Manslaughter" or even a murder charge, not you. Happened here in Colorado just a few months ago. Road rage is bad. Guy got all pissy, rolled in front of a slower driver and locked his brakes, injuring the people in the car behind him. Now he is someone's girlfriend in prison.

If you hit them, you are going to be the one who will be initially suspected "at fault". However, you need to get your insurance company on your side. The insurance company doesn't like paying money. If you tell your insurance company (and the cops) that the accident was intentional, you can take it to court.

If it is proven that this accident was set up for insurance purposes the person you inadvertently hit would be ticketed and reported to the insurance company who probably has that person on their radar screen anyway.

I would hit them.... if they intentionally cut in front of me to cause an accident. I would not fear repercussion as the law would be on my side, a good driver knows right from wrong.

Licence plate number and discription of driver, turn that into police, other then that there is little that you can do.
