Can a paternity test be done without the mother being present? (Just swab the father and the baby) Or Does the mother have to be swabbed to? What if its done without the mothers consent can she sue?

Yes, a paternity test can be done without the mother being present. Even if the doctor doesn't consent to it the man SHOULD ask for one in court. Men deserve to know if the baby they believe to be their own is actually theirs. A mother shouldn't sue the "father" because it's HIS right to know.

I am not sure. That probably wouldn't be right though would it. It should be petitioned through the court. And for the sake of the father and baby in question, I hope everything turns out right. Because if the mother ever found out....someone will have to answer for it.......I don't know if you are the mother or if someone else is, your details where a little sketchy. If you are not the mother this isn't your business. It should be between the mother and the father of the baby.

the mother is swabbed too to make sure there is no baby swap done. cant be done with out moms consent unless mom has lost custody and the baby is in the states care

I think just the baby and the father. It is the father who is questioning the paternity of the baby right?

If you have legal recourse (ie you want child support) it's pretty hard to refuse the paternity test on yourself.
