The answer.......... the defendant was a siamese twin. The judge couldn't punish the guilty without punishing the innocent too.

It was a case of murder for hire. The judge paid the defendant to murder someone.

The defendant is the person accused of the crime, not the victim so there's no reason to think he's dead. Unless he murdered himself?

Unfortunately I am not the first one to answer this but I will anyway I would assume that the defendant would have to be dead if he was murdered.
