Yes you can. Non-alcoholic beer has alcohol in it, just in a small percentage. When these beers are produced, they are made as full strength alcoholic beer. During the manufacturing process, the alcohol is removed. There is no way to remove it all, and the label on the bottle states the amount of alcohol in each one. For example, O' Doul's (the highest selling brand of non-alcohol beer) has a 0.5% alcohol by volume. If these types of non-alcoholic beer really had no alcohol, then they could be purchased by minors. You have to be of legal age to buy them for that reason.
Granted, you would have to drink a very large quantity of them to be impaired and fail a breathalyzer, but you can legally be ticketed for having an open container.

I am not aware of any state which will ARREST you for having an open container of an alcoholic beverage in a motor vehicle, let alone a non-alcoholic one. Unless you are drunk, you will receive a ticket (and they will take the container(s)), and you are sent on your way.

There are still many states, like mine, which prohibit the possession of a malt beverage which contains any alcohol from being stored in the passenger compartment (accessible to the driver) of a motor vehicle. However, 99% of the prosecutors (like myself) have better things to do than prosecute a "non-alcoholic beer-possession case."

No such thing as non-alcoholic beer - check the bottles and its ingredients, a prosecuter nailed a friend of mine on that scenario. He was convicted of open container and DUI, because of the ingredients similar to regular beer.

Beer has alcohol in it. If it didn't have alcohol, it wouldn't be beer.
"Near-beer" and other beers labeled non-alcoholic all contain alcohol, just in lesser quantities.
Most states' open container laws prohibit ANY alcoholic beverage, including alcoholic beverages that are "just a little bit" alcoholic.

The only non alcoholic beer I know of is ROOT BEER. I guess, technically, it's not beer. I love root beer.
