Before everyone gets worked up, let's rewind:

The goal of a prosecutor (who operates in the executive branch) is to enforce the laws (set forth by the legislative branch) within the court system (the judicial branch).

A Prosecutor, unlike a defense attorney --or any other attorney who operates within the US legal system -- is required to seek justice, NOT a win, NOT a conviction. Most people do not know this, but I won't call them ignorant or berate them for not educating themselves about our legal system. In fact, I have often wondered how many prosecutors have forgotten their role.

As a prosecutor, I have encountered cases where I didn't know exactly what the defendant did to constitute a crime when I read the report. Granted, these are generally misdemeanor crimes regarding DNR (Dept. Natural Resource) violations, but they are still crimes. The defendant is still expected to know the law and pay the fine for any violations...

But after ten years of being in the law business, and I don't have a clue what this guy did to violate the law --I'm not going to crack open a book, or get online, to try to figure out how to make sure he gets convicted and pays. That's not justice. That's idiocy. That's ridiculousness.

Because a prosecutor's role is "justice," there is room for common sense. And I can say, at least in my jurisdiction, I try to use common sense in enforcing the law; whether it be a DNR violation or something more serious.

Well for one thing you should at least spell correctly. Back to the subject. When it comes to law, man (or woman) should have enough common sense to educate themselves. When you move to another country you should have the common sense to know something about their laws and THEIR way of life before you migrate there. This pertains to not only the immigrants coming into the U.S. but years ago the young college students studying in China who were arrested for destroying other people's property, many in the U.S. were horrifed to hear that their breaking the law was punishable by caning. My contention was that those students were living in that country basically as "guests" and SHOULD have paid attention to the laws of the land there and not thought they would get off with just a slap of the hands simply because they were U.S. citizens. I said cane them.

Yes he should be punished. And if you received your education through the free public school system of the United States, they shoudl be punished, because they didn't do their job. That being said, and truly, it is simply spell check so don't take that to heart too much, yes, people should be punished. It is not a societies job to educate the masses on all of the laws. It is the masses civil responsibility to educate them selves. It is the difference how an adult thinks vs a child. An employer vs an employee, a proactive person vs a reactive person. People who wait to be "educated" are simply lazy sheeple that are destined to stay where they are in life, because they wait for someone else to make it better.
Good Luck.

You cannot force an ignorant man to go to school . Only punishment teaches him to be obedient to law.
