No, the biological mother wont sign over rights, and yes she has been ordered to pay child support for three years now and hasn't paid a dime, she is a drug addict and dont have a job, so they cant garnish wages from her. She has 4 kids and dont have custody of any of them, she never contacts me and shows no interest in any of her children, so it seeems to me that there is a way around this to make it simple, since she shows no concern for any rights, some one out there knows something, please fill me in and I wish to have known facts rather than opinions, (I have enough of them on my own) Thanks and God Bless

Since your child's biological egg donor will not pay the back child support see if an attorney can get something worked up to allow her to sign over her parental right in exchange for being released from owing you the unpaid child support. I know this worked for my dad, but this was from a long time ago. It's worth a shot.

Since Im going through this now, I dont know about the state you are in but the state I am in the parents rights have to be terminated at some point before adoption can be done. And I would talk to a lawyer about it and he/she can fill you in on the laws in the state you live in and on how long your wife needs to wait after the termination of rights. Usually its 6 months to a year. That is what my husband now has to do. And there will be counseling for both child individually and then family wise. Good luck with it. And your wife is a good person if she wants to adopt a child that isnt hers.

I have a friend who was also in this situation. She wanted her husband to adopt her daughter because the biological father wanted nothing to do with her. She talked to a lawyer and was told of the bioligical father went three years without seeing his daughter or paying any child support the courts could sign away his rights. It never worked out though for her because before the three years was up he would call to see the little girl or pay her some money. I know some states may be different. This was in Wisconsin. I'd think that you could sue for full rights if she's not being a good mother. I'd contact a family lawyer and see what they say. They could decide that with what she's doing that she's unfit and that they can take away rights, but I really have no idea, good luck

If the state declares her a unfit mother the state can revoke her parental rights without her consent. Talk to your lawyer.

good for u for taking care of ur baby girl ~
and i think ur ex has to sign over rights in order for ur wife to adopt .. no way around it

i was adopted by my step dad at age 10 my mom and him fought my real daddy for 6 yrs. b4 he gave in ..
maybe becuz she's sick, a lawyer or something can help it be easier ..

If her organic and organic mom does no longer approve (regardless of if she has no contact and has abused your daughter in the previous), your spouse isn't allowed to undertake her daughter, regardless of what your daughter needs. that is the regulation.
