talk to a lawyer, sometimes you can get the biological mother to sign over parental rights. then it's all about who takes the child in and cares for her.

I went through this when my husband wanted to adopt my daughter.

First--consult a lawyer. In the long run, it could save you money.

In our state, you have to be married at least 6 months before your spouse can file to adopt your child.

Is she supposed to pay you child support? If she is, and you have an accurate account of how much she owes, that would be a good thing to give to your lawyer.

The court will probably send out a social worker to interview both of you, the child (if old enough), and maybe some neighbors. The worker also watches how the adoptive parent interacts with the child They normally make one announced visit, and one unannounced visit.

If everything checks out, you will then get a court date to come before the judge and finish the adoption process. In my case, my daughter came up and sat on the judge's bench and talked to him.

It may cost you a bit, but it is WELL worth it in the long run!

I wish you the best of luck, and I hope that this helps you.

considering Im dealing with this now, I dont study the state you're in besides the undeniable fact that the state i'm in the mummy and father rights must be terminated in some unspecified time sooner or later in the previous adoption would properly be done. and that i'd examine with a legal professional about it and he/she will fill you in on the guidelines in the state you stay in and on how lengthy your spouse needs to attend after the termination of rights. oftentimes its 6 months to a three hundred and sixty 5 days. that is what my husband now has to do. And there'll be counseling for both newborn in my view and then kinfolk smart. solid success with it. And your spouse is an effective individual if she needs to undertake a newborn that isnt hers.
